- License: The authorization granted to the buyer to use the plugin under the terms of this agreement, tied to the specified domain and to its license key.
2. Purpose of the Agreement
Infixs plugins are licensed, not sold, to the Buyer and the Domain Owner. The license granted allows each plugin to be used under the terms defined in this document and the conditions of the plan purchased, such as the number of sites and the validity period.
3. License of Use
3.1. The license is individual, non-transferable and tied exclusively to the domain(s) used to activate it, within the site limit of the plan purchased. Use of the plugin is strictly limited to such domain(s). The Buyer and the Domain Owner of the domain where the plugin is installed and used are responsible for the use of the license and for accepting the terms of this agreement. Both may be held liable for any breach of the conditions set forth in this document.
3.2. Use of the plugin is limited to the permitted purposes, as specified on each plugin’s official page.
3.3. The buyer is not permitted to sublicense, rent, assign, donate, sell, share or distribute the plugin, in whole or in part, to third parties.
4. Intellectual Property
4.1. All intellectual property rights relating to the plugins, including, but not limited to, source code, design, layout, visual structure and functional organization, are owned exclusively by Infixs.
4.2. The buyer is not authorized to copy, modify, adapt, reverse engineer, decompile, create derivative works from, or reuse any part of the plugin’s code, design or features.
4.3. Reproducing the plugins’ visual elements and layouts, including, but not limited to, screen organization, color palette, component arrangement and texts, is strictly prohibited without the express written authorization of Infixs.
5. Restrictions on Use
5.1. The plugins may not be used for unlawful or unethical purposes or purposes contrary to the provisions of this agreement.
5.2. Any attempt to disguise or conceal the use of the plugins’ code, visual elements or features by renaming functions or variables, or by any other method, will be considered a breach of these Terms.
5.3. The plugins may not be used as a basis for developing competing or derivative products.
6. Warranties and Liability
6.1. Infixs warrants that each plugin will work as described in its official documentation, except for failures caused by external factors or misuse by the buyer.
6.2. Infixs is not liable for direct, indirect or consequential damages arising from improper or inappropriate use of the plugins.
6.3. Purchasing and using a plugin implies acceptance that it was acquired “as is”, and any changes outside the contractual conditions may result in the revocation of the license.
7. Penalties for Breach
7.1. Breach of any of the clauses above will result in the immediate revocation of the license and loss of access to future updates and technical support.
7.2. In addition, Infixs may take the appropriate legal measures to obtain compensation for moral and material damages, including, but not limited to, lawsuits and extrajudicial notices.
7.3. Infixs may suspend, terminate or cancel the purchase and/or the license whenever it detects signs or suspicion of a breach of these Terms, including while the matter is under investigation.
8. Joint and Several Liability
8.1. The registered buyer and the person responsible for the domain where the plugin is installed and used are jointly and severally liable for fulfilling all contractual obligations set forth in this agreement.
8.2. Joint and several liability means that either party may equally be held accountable for any breaches, defaults or damages caused by non-compliance with the provisions of this agreement.
8.3. In the event of a breach of any clause of this agreement, Infixs reserves the right to take the appropriate legal measures against either or both of the jointly and severally liable parties, without having to pursue one before the other.
8.4. Joint and several liability includes, but is not limited to, obligations related to misuse of the plugins, unauthorized reproduction of code or design, and unauthorized sharing or distribution of the software.
8.5. This joint and several liability clause remains in force regardless of any transfer of ownership of the domain or change of ownership of the plugin.
9. Acceptance of the Terms
9.1. By installing or using any Infixs plugin, the buyer expressly declares that they have read, understood and fully agree with the terms of this agreement.
9.2. If the buyer does not agree with the terms, they must refrain from installing or using the plugins and contact Infixs for clarification.
